Dear Mr. McGhie: I write on behalf of Barry Jerrels, proponent of the Video Lottery Initiative of 2006 and the Video Lottery Initiative of 2006 B filed March 14, 2006 and scheduled for a hearing by Board of Elections and Ethics this morning. Yesterday evening I received a copy of the comments from the General Counsel of the Council of the District of Columbia concerning whether these initiatives were "proper subjects." In her comments, General Counsel Charlotte Brookins-Hudson raised an issue that had never before been presented. The language Ms. Brookins-Hudson questioned had been previously approved by the Board and the Superior Court, and was deemed appropriate by the Attorney General in his submission. Nevertheless, we would like the opportunity to work with the Council to resolve the concerns that were raised. Accordingly, we withdraw these initiatives. We will consult with Ms. Brookins-Hudson and attempt to resolve the concerns she expressed before resubmitting. If you have any questions regarding this matter, please contact me. |
