A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

Chairman Linda Cropp, on behalf of the Mayor, introduced the following resolution, which was Referred to the Committee on the Judiciary.

To approve the proposed rule to amend the Traffic Regulations of the District of Columbia relating to the stopping, standing, or parking of motor vehicles.

RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as "The Omnibus Criminal Justice Reform Amendment Act of 1999".

Sec. 2. Pursuant to section 401 of The Omnibus Criminal Justice Reform Amendment Act of 1994, relating to the stopping, standing, or parking of motor vehicles, effective August 20, 1994; (D.C. Law 10- 151; 18 DCMR 2425) the Mayor transmitted to the Council of the District of Columbia a proposed rule to amend the Traffic Regulations of the District of Columbia, relating to the stopping, standing, or parking of motor vehicles. The Council approves the proposed rule to amend Chapter 24 of section 401 of The Omnibus Criminal Justice Reform Act of 1994 (D.C. Law 10-151; 18 DCMR 2425.2, 2425.5, 2426.1, 2427.1, 2427.2, 2428.1 through 2428.3, 2601.1, 9901.

Sec. 3. This resolution shall take effect immediately upon the first date of publication in the District of Columbia Register, the District of Columbia Statutes-at-Large, or the District of Columbia Municipal Regulations.

NOTICE OF PROPOSED RULEMAKING
DOCKET NO. 99-38-PE

The Director of the Department of Public Works, pursuant to the authority of Section IV(A) and V of Reorganization Plan No. 4 of 1983, 30 DCR 6428 (December 16, 1983), effective March 2, 1984, and Mayor's Order 84-55, 31 DCR 1323 (March 16, 1984), hereby gives notice of the intent to amend the Vehicles and Traffic Regulations (18 DCMR). The purpose of this rulemaking is to specifically identify residential areas in the District of Columbia where chronic parking problems persists due to a lack of available legal parking spaces. The affected residential areas will be labeled as "High Density Parking Areas".

Chapter 24 of 18 DCMR, contains both the implementing rules and the relevant language of the law relative to stopping, standing, parking, and other non-moving violations. Pursuant to Section 401 of the Omnibus Criminal Justice Reform Amendment Act of 1994, effective August 20, 1994 (D.C. Law 10-151); this rulemaking proposes to add new sections to Chapter 24 of the Vehicles and Traffic Regulations (18 DCMR) entitled; Section 2426, CERTIFIED RESIDENT; Section 2427, MINOR VIOLATIONS; PARKING MORATORIUM; Section 2428, ESTABLISHMENT AND APPROVAL OF HIGH DENSITY PARKING AREAS. This rulemaking also proposes to amend 18 DCMR Section 9901 and subsections 2425.2, 2425.5.

Final rulemaking action shall be taken in not less than forty-five (45) days from the date of publication of this notice in the D.C. Register. This rulemaking is subject to review by the Council of the District of Columbia pursuant to Section 401 of D.C. Law 10-151, supra The following rulemaking action is proposed:

A. Title 18 DCMR, Chapter 24, STOPPING, STANDING, PARKING, AND OTHER NON-MOVING VIOLATIONS, Section 2425, PARKING MORATORIUM, Subsections 2425.2 and 2425.5 are amended to read as follows:

2425.2 The minor parking violations are the offenses cited in subsections 2405.2(c) (within forty-feet (40 ft.) of intersecting streets or within twenty-five feet (25 ft.) of an intersection on a one-way street) 2405.2 (i) parking within three feet (3 ft.) of another parallel parked vehicle in a non-metered area) and 2405.3 (d) (within twenty-five feet (25 ft.) of motorists courtesy mail boxes). No citations shall be issued for the minor parking violations listed above between 11:00 p.m. and 7:00 a.m. in high density parking areas for vehicles registered to certified residents.

2425.5 This section shall expire on December 31, 2002.

B. Title 18 DCMR, Chapter 24, STOPPING, STANDING, PARKING, AND OTHER NON-MOVING VIOLATIONS, is amended by adding a new Section 2426, CERTIFIED RESIDENT, to read as follows:

2426 CERTIFIED RESIDENT

2426.1 For the purpose of this section the term:

"Certified Resident" means any person residing within the District and within a designated high density parking area that possesses a current residential parking permit.

C. Title 18 DCMR, Chapter 24, STOPPING, STANDING, PARKING AND OTHER NON- MOVING VIOLATIONS, is amended by adding a new Section 2427, MINOR VIOLATIONS: PARKING MORATORIUM, to read as follows:

2427 MINOR VIOLATIONS: PARKING MORATORIUM

2427.1 Minor parking violations subject to the parking moratorium are as follows: Courtesy mail boxes, Subsection 2405.3 (d); Intersections, Subsection 2405.2 ( c) and parking within three feet (3 ft.) of another parallel parked car, Subsection 2405.2 (i ).

2427.2 The "High Density Parking Area" shall include all parking spaces on both sides of the following street segments, and all other street segments under District of Columbia jurisdiction which are contained within the boundaries established by these street segments:

D. Title 18 DCMR, Chapter 24, STOPPING, STANDING, PARKING AND OTHER NON-MOVING VIOLATIONS, is amended by adding a new Section 2428, ESTABLISHMENT AND APPROVAL OF HIGH DENSITY PARKING AREAS, to read as follows:

2428 ESTABLISHMENT AND APPROVAL OF HIGH DENSITY PARKING AREAS

2428.1 The Director shall establish objective criteria to use in determining whether or not a block of a street is eligible for designation as a high density parking area.

2428.2 The Director has determined that the objective criteria for designating a block of a street as a high density parking area block is identical to the objective criteria used for the establishment and approval of residential permit parking areas as listed in Subsections 2412.2 through 2412.13.

2428.3 This rulemaking (99-38-PE) shall expire on December 31, 2002.

E. Title 18 DCMR, Section 2601, PARKING AND OTHER NON-MOVING INFRACTIONS, Subsection 2601.1, is amended by inserting the following new civil parking fine category:

High Density Parking Area Space: unauthorized vehicle in {subsection 2427.23...$100.00

F. Title 18 DCMR, Section 9901 DEFINITIONS, is amended by inserting the following new definitions:

Certified Resident -- any person residing within the District and within a designated high density parking area that possesses a current residential parking permit.

High Density Parking area -- a residential area in the District where a chronic parking problem persists due to a limited number of parking spaces and an inordinate number of motor vehicles as determined by the Department of Public Works.

MPD - the Metropolitan Police Department of the District of Columbia.
