Subject: Proposal to Adopt Policy on the Replacement of Lead Service Lines

RESOLUTION
OF THE
BOARD OF DIRECTORS
OF THE
DISTRICT OF COLUMBIA WATER AND SEWER AUTHORITY

The Board of Directors, (the "Board") of the District of Columbia Water and Sewer Authority, (the "Authority") at its meeting on April 2, 2004, upon consideration of a non joint use matter decided by a vote of _____  () in favor and ______  () opposed, to take the following action with respect to a proposed policy on the replacement of lead service lines.

WHEREAS, the Customer and Community, Services Committee on March 22, 2004, recommended that the Board establish a policy on replacement of lead service lines; and

WHEREAS, these recommendations were considered on March 24, 2004, by the Environmental Quality and Operations Committee and on March 25, 2004, by the Finance and Budget Committee and by the Retail Rates Committee; and

WHEREAS, the Retail Rates Committee has recommended that the Board adopt a policy promptly, with the benefit of public participation through oral and written comments, and that the policy address City-owned service lines within the public space, for which the Authority has responsibility under current law, while recognizing also the importance of the service line on the homeowner's side of the property line.

NOW THEREFORE BE IT RESOLVED THAT:

1) The Board of Directors proposes to adopt the following policy:

(a) It is the policy of DC-WASA to have no lead service lines in the public space portion of its water supply system. Therefore, the Authority will remove all known lead service lines from the public space no later than September 30, 2010, and replace these lines with EPA-approved service lines. In the future, if a lead service line is discovered that was not previously identified and replaced prior to September 30, 2010, the Authority will replace the public space portion of that service line within 90 days of knowing of its existence.

(b) Recognizing the significance of privately-owned portions of the lead service lines which are outside its present legal responsibility, the Authority will also encourage homeowners to eliminate lead service lines on their properties, and will coordinate with and facilitate private and public efforts to that end, including offering homeowners an opportunity to replace the private portion of lead service lines with EPA-approved service lines at the Authority's actual cost.

2) The Board of Directors directs the General Manager and the Secretary of the Board to:

(a) give public notice of the text of the proposed policy in the D.C. Register and other publications;

(b) mail copies of the proposed public policy to all Advisory Neighborhood Commissions in the District of Columbia, to all individual ANC commissioners, and to civic associations;

(c) schedule at least two public, community meetings in April and early May during which members of the public may secure information and offer comments;

(d) invite written comments from members of the public to the Board of Directors up to and including Friday, May 28, 2004.

3) The Board of Directors plans to reach a decision on a lead line removal policy that is consistent with the Board's financial policies during June, 2004.

NOW THEREFORE BE IT FURTHER RESOLVED THAT:

The Board of Directors hereby authorizes the General Manager to seek public comment on the text of the proposed policy and authorizes the General Manager to take all steps necessary to carry out the intentions expressed in this resolution.

This resolution is effective immediately.
