Dear Chief Lanier:
I write regarding the June 4 announcement of Neighborhood
Safety Zones (NSZ) and the June 4 public hearing on Bill 17-111, the
"Hot Spot No Loitering Zone Amendment Act of 2008" held by
the Committee on Public Safety and the Judiciary.
These issues have commonality in their questionable
treatment of District residents' civil liberties. It is regrettable,
that the Executive chose yet again to not send a representative to the
public hearing. Both the Committee members and public were denied an
opportunity to discuss these serious issues in an open and transparent
manner.
In order for the Committee to conduct its oversight
duties, please provide the following information. Avoid the use of
attachments unless specifically requested.
- As an attachment, the special order
for NSZs and any other order (general or special order) that is relevant
to NSZs;
- As an attachment, any Mayor's
order(s) relevant to the establishment of authority to create and/or
enforces NSZs;
- A copy of any legal opinions by the
Office of the Attorney General related to the NSZs;
- A table depicting the number of arrests and
convictions made (separated by fiscal year; starting with FY 2006 and
ending June 1, 2008), pursuant to drug free zones established by D.C.
Official Code § 48-1005;
- A table depicting the number of arrests and
convictions made (grouped by fiscal year; starting with FY 2006 and
ending June 1, 2008), pursuant to drug free zones, established by D.C.
Official Code § 48-904.07a;
- A table depicting the number of arrests and
convictions made (grouped by fiscal year; starting with FY 2006 and
ending June 1, 2008), pursuant to prostitution free zones, established
by D.C. Official Code § 22-2731;
- A table depicting the number of arrests and
convictions made (grouped by fiscal year; starting with FY 2006 and
ending June 1, 2008), pursuant to gun free zone enhanced penalties,
established by D.C. Official Code § 22-4502.01.
