INITIATIVE, Petitioner, BEFORE: Farrell and * Ruiz, Associate Judges, and Newman, Senior Judge. ORDEROn consideration of petitioner's motion for leave to file separate and lodged appendix, the motion filed by Mister Baxley, et al, to intervene and file the lodged brief, or in the alternative, to appear as amicus curiae and file the lodged brief and the motion filed by the American Civil Liberties Union appear as amicus curiae and to file the lodged brief, it is ORDERED that petitioner's motion for leave to file separate appendix is granted and the Clerk shall file the lodged appendix. It is FURTHER ORDERED that the motion of Ester Baxley, et at., to intervene is denied. It is FURTHER ORDERED that the alternative request of Ester Baxley, et al. to enter an appearance as amicus cures I denied. It is FURTHER ORDERED ; hat the motion of the American Civil Liberties Union to enter an appearance as amicus curia r is granted and the Clerk shall enter them as amicus curiae and fide the lodged brief.
