A PROPOSED RESOLUTION IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To confirm the appointment of Ms. John P. Isa to the Public Employee Relations Board. RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Public Employee Relations Board John P. Isa Confirmation Resolution of 2009”.

Sec. 2. The Council of the District of Columbia confirms the appointment of:

as a public member of the Public Employee Relations Board, established by section 501 of the District of Columbia Government Comprehensive Merit Personnel Act of 1978, effective March 3, 1979 (DC Law 2-139; DC Official Code 1-605.01), replacing Iris McCollum Green, whose term ended December 12, 2007, for a term to end December 12, 2010.

Sec. 3. The Council of the District of Columbia shall transmit a copy of this resolution, upon its adoption, to the nominee and to the Office of the Mayor.

Sec. 4. This resolution shall take effect immediately.

  • Represent employers in class and single plaintiff actions arising under federal and state employment statutes including FLSA, Title VII, ADA, ADEA, FMLA and NLRA.
  • Prepare motions, discovery responses, pleadings, appellate briefs, position statements, settlement agreements, noncompete agreements and offer letters.
  • Represent employers at court hearings, arbitrations, mediations and administrative proceedings before the EEOC, NLRB and other government agencies.
  • Conduct and defend depositions of parties, experts and third party witnesses.
  • Advise clients on proper handling of reductions-in-force (RIFs) and prepare key related documents such as severance agreements, plan documents and OWBPA disclosures.
  • Conduct workplace investigations, wage & hour audits and human resource audits.
  • Ensure compliance with electronic discovery obligations including meeting with in-house counsel and preparing litigation hold directives, interviewing IT personnel to discuss company capabilities and procedures and meeting with opposing counsel to discuss discovery parameters.
  • Worked in-house for two years at Wal-Mart, at client's request, to:
    • establish, hire and train in-house staff for the Employment Practices Division and EEOC Compliance Group of the General Counsel's office;
    • advise the General Counsel of Employment Practices Division on best human resource practices and litigation prevention;
    • assist the Associate General Counsel of the EEOC Compliance Group in creating internal EEOC processes including quality control and consistency in the preparation of EEOC position statements, establishing a nationwide network of outside counsel, tracking charges and allegations by state and facility location to monitor potential class and management problems, providing reports to executives of trends and critical areas for improvement, and meeting with executives and directors to discuss settlement options and case strategies; and 
    • counsel the Chief Diversity Officer on diversity programs, diversity goals for executives, supplier diversity programs and employee resource groups.
  • Prepare ERISA plan documents and executive compensation agreements and advise clients on compliance with DOL and IRS regulations.
  • Prepare articles on employment law trends and draft policy speeches for testimony on Capitol Hill.
  • Provide pro bono services to Human Rights Campaign, United Cerebral Palsy, National AIDS Foundation and House of Ruth.
